These Terms of Use (“Terms”) govern your download and use of the ProgressPic mobile application (“the App”). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
This App is licensed (not sold) to you. Your use is also subject to Apple’s standard Licensed Application End User License Agreement (“Apple EULA”), available at: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/ — the terms below are in addition to that agreement and, where they conflict, the Apple EULA controls for distribution-related matters.
Subject to your compliance with these Terms and the Apple EULA, we grant you a personal, non-transferable, non-exclusive, revocable license to install and use the App on any Apple-branded device that you own or control, for your personal, non-commercial use.
You may not:
The App lets you create and store content (weight entries, measurements, photos, notes, goals). You retain all rights to that content. Because content is stored on your device (and optionally in your private iCloud), we do not claim any ownership of it and we do not access it.
You are solely responsible for your content and for maintaining backups (iCloud sync is the recommended backup mechanism — see the Privacy Policy).
The App offers optional in-app purchases, including a premium subscription (“ProgressPic Premium”). Purchases and subscriptions are processed by Apple through the App Store and are subject to the Apple Media Services Terms: https://www.apple.com/legal/internet-services/itunes/

Refunds: All payments are handled by Apple. Refund requests must be submitted directly to Apple at https://reportaproblem.apple.com/
ProgressPic is a tracking and self-monitoring tool. It is not a medical device and does not provide medical advice, diagnosis, or treatment.
Your use of the App’s information is at your own risk.
If you grant the App access to the Camera, your Photo Library, or notifications, that access is used only as described in the Privacy Policy. You can revoke any permission at any time in iOS Settings.
We may update, change, or discontinue features of the App at any time without notice. Some features may require a minimum iOS version. We are not liable for any modification or discontinuation of the App.
The App, including its design, code, graphics, and trademarks (including the name “ProgressPic”), is owned by Yaswanth Raja and protected by intellectual property laws. Except for the limited license granted in Section 1, no rights are granted to you.
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE OR UNINTERRUPTED, OR THAT DEFECTS WILL BE CORRECTED.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL YASWANTH RAJA OR THE APP’S CONTRIBUTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR HEALTH OUTCOMES, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE APP.
OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE APP OR IN-APP PURCHASES IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $20.
You agree to indemnify and hold harmless Yaswanth Raja from any claim, damage, or expense (including reasonable attorneys’ fees) arising out of your misuse of the App or your violation of these Terms or applicable law.
You acknowledge that Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and that upon your acceptance Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
These Terms remain in effect until terminated. You may terminate at any time by deleting the App. We may terminate or suspend your license at any time if you breach these Terms. Sections 2, 4, 7–11, and 13–14 survive termination.
These Terms are governed by the laws of your country/state of residence, without regard to its conflict-of-laws rules, except that mandatory consumer-protection laws of your jurisdiction continue to apply.
We may update these Terms from time to time. The “Last updated” date at the top of this page will reflect any changes. Continued use of the App after changes take effect constitutes acceptance.
